Terms & Conditions

Sailing and racing on yachts can be a challenging activity depending on the conditions and has a degree of inherent risk that will be managed in accordance with the Royal New Zealand Yacht Squadron risk management procedures, sailors should be aware and accept responsibility for these risks.

The coaching team, led by the Head Coach, is responsible for the safety of the boats and everyone at the specifief event and all the people participating and is also responsible for complying with all the relevant rules and regulations. For the safety of everyone participating, all sailors must adhere to the coaching teams’ instructions at all times.

The Royal New Zealand Yacht Squadron requires all sailors to sign the following acknowledgments:

All those taking part in RNZYS races or any other sailing events controlled by the RNZYS, as between the RNZYS and each of those so taking part, do so at their own risk and responsibility.

Terms & Conditions Acknowledgements

I understand I will be briefed on all safety procedures at the start th event and at the daily briefings and I confirm I will follow all safety procedures.
I agree that I will accept responsibility for observing all safety procedures (including wearing of safety clothing and equipment), obey all instructions and using all equipment, both on and off the water, in a proper manner.
I agree and accept that the Royal New Zealand Yacht Squadron, and any associated sponsors are not responsible for any injury or death sustained by participants or damage to personal property for any cause whatsoever. I understand that the RNZYS does not accept responsibility for loss or damage to personal property and that it is my responsibility to check my own insurance policy, and care for my own personal items.

Medical Declaration

Participants with medical conditions will be accepted at the discretion of the Head Coach in conjunction with the RNZYS General Manager.

I confirm that I have disclosed all known medical conditions, medications, and relevant information on the medical declaration form.

We do anticipate that sailors, staff and/or volunteers may become unwell during the week - this is expected. The purpose of a ‘pre-departure’ test is to help us reduce the risk of illness traveling to the island with us. We appreciate your support.

Illness at the event - Should a sailor, staff member or volunteer become unwell throughout our course, the individual will be isolated and tested, to reduce the risk of illness spreading among sailors, staff and volunteers.

Medical Declaration Acknowledgement

I will only attend the event if I am fit and well.
I confirm that if I suffer from any cold or flu symptoms or become unwell during the event I will immediately advise the designated First Aid person.
I acknowledge that RNZYS reserves the right to send me home from the event if I am unwell and all travel expenses after returning to the RNZYS will be at my own expense.

Medical Attention

Where a staff member (or volunteer) is unable to contact a parent or caregiver or it is otherwise impracticable to do so, I authorise the staff member (or volunteer) to:
- provide or seek medical support to provide such medical or surgical attention as deemed necessary by a medical practitioner.
- Administer such first aid as the staff (or volunteer) may judge to be reasonably necessary.

Sailing & Weather

The RNZYS and any sponsor associated with this event shall not be responsible for the competence of any skippers or crews.

The RNZYS reserves the right to shorten the event or remain on land if the weather is of such an adverse nature that it makes either sail training completion of the course unsafe.

If the Head Coach considers the safety of the participants or the yachts is unduly compromised due to weather, forecast weather, or other circumstances the course, or the individual or teams’ participation in the course may be changed, delayed, or shortened to appropriately manage relevant safety risks.

The RNZYS takes no responsibility for delays in transit as part of the course that result in travel disruption or additional costs for participants as the result of weather or other events beyond the control of the RNZYS. Participants should take this into consideration when making travel arrangements to attend the event.

Media & Communications

The Royal New Zealand Yacht Squadron have the right to use any digital media, photos, videos or other content acquired during the training weeks in the public domain, this includes on our website, for promotion purposes and on social media.

Participation

The RNZYS reserves the right in its sole and uncontrolled discretion to refuse any sailor, for any reason it sees fit, up to and including on the day the course starts. The RNZYS reserves the right to ask any participant to leave the course at any time for any conduct that risk the safety or wellbeing of other participants or the coaching staff.

Behaviour Expectation

Behaviour expected whilst at the event should be discussed beforehand between the Parent/Caregiver and the sailor. A high level of good behaviour is expected to be adhered to while attending Tevent. Should any serious behaviour problem arise which would be detrimental to the well-being of the sailor or others present, we understand the sailor will be sent home at the family’s expense.

Parent / Guardian Acknowledgement

I/We hereby agree to allow our sailor to participate in the event to be held at the Royal New Zealand Yacht Squadron. I confirm I have read all of the above disclaimers and discussed these with the sailor – who understands these requirements and both the sailor and I as their Parent/Guardian agree to the disclaimer and liability conditions.

In acknowledging this document, I am aware of the general nature of the activities and that these activities represent a change in the sailor’s normal routines and are/maybe physically demanding. RNZYS and its staff/volunteers make all reasonable efforts to eliminate or minimise the risks but I understand that all hazards and dangers associated with the activities of the event may not be foreseen or may be beyond the control of the RNZYS and staff and volunteers.
